26. Crime, punishment, and counselling – a study of the local judicial and social work application of prostitution policy in Sweden
Sammanfattning : This thesis explores the social construction of a purchase of a sexual service within the implementation of prostitution policy in Sweden and seeks to contribute to the current knowledge about how a purchase of a sexual service is regulated based on how the law and social work are locally implemented. The thesis consists of four papers based on two empirical studies, including legal documents concerning the enforcement of the Swedish Sex Purchase Act (Chapter 6 Section 11 of the Criminal Code), and interviews with professionals within social services providing counselling to individuals with the experience of purchasing sexual services. Sammanfattning : This work aims at framing, from a normative perspective, a field in which to locate one of the means of allowing politics to become law: the policy of law. The first part is devoted to the exploration of the relationship between law and politics as considered by major current schools of legal theory, such as legal positivism (Kelsen), analytical jurisprudence (Hart), Finnis’ natural law theory, American and Scandinavian legal realism, Critical Legal Studies and Law and Economics. Sammanfattning : This thesis explores how philosophical perspectives of justice can facilitate a critical discussion and a deepened understanding of the school choice issue and how it can be related to fundamental pedagogical ends of education, such as developing children´s autonomy and educating them to become democratic citizens. The methodological approach is based on John Dewey’s view of pragmatism, which argues for an experimental process of inquiry incorporating reflection on alternative lines of action. LÄS MER
