    Sammanfattning : The purpose of the compilation thesis has been to compare the ability to recharacterize cross-border transactions under the OECD Transfer Pricing Guidelines, 2010 version (OECD Guidelines), and OECDs new guidance from the BEPS project 2015 (Final Report) with the possibility to reclassify legal transactions in accordance with Swedish domestic law. The latter is an interpretation of the Swedish Supreme Administrative Court’s (SAC) case law on the taxation of transactions based of their true import. LÄS MER

    Sammanfattning : For a long time confined to Article 106(2) TFEU, a provision allowing to justify regulatory measures derogating from Treaty rules by invoking their necessity in order to enable undertakings entrusted with services of general economic interest (SGEIs) to fulfil their special tasks, SGEI has become a constitutional concept of EU law. In the post-Lisbon EU Treaties it is subject to new provisions, in particular Article 14 TFEU and the Protocol on services on general interest. LÄS MER

    Sammanfattning : This thesis explores the scope and limits of Article 4(h) of the AU Act in order to generate new thinking on, and contribute a fresh legal approach to, the implementation of the AU’s right to intervene under Article 4(h). While Article 4(h) intervention can be construed as enforcement by consent, it is not clear whether the UN Charter provides for enforcement action by consent to be outside the purview of Article 53(1) of the UN Charter.
