  1. 1. From Idea to Norm : Promoting Conflict Prevention

    Författare :Annika Björkdahl; Statsvetenskapliga institutionen; []
    Nyckelord :SAMHÄLLSVETENSKAP; SOCIAL SCIENCES; Polemology; international relations; social constructivism; norm entrepreneur; norm evolution; international norms; Swedish foreign policy; the European Union; conflict prevention; the United Nations; Freds- och konfliktforskning;

    Sammanfattning : This study is concerned with tracing the process of how conflict prevention is moving from the realm of ideas to the field of action. Why is it that, despite historical as well as recent evidence of the infeasibility to prevent wars, the idea of conflict prevention has resurfaced to meet the challenge of the new wars of the post-Cold War era? The study investigates whether the growing interest in preventing the outbreak of violent conflicts marks the coming of age of conflict prevention as an international norm able to induce preventive practices. 2. 2. Why Grundnorm? A Treatise on the Implications of Kelsen's Doctrine

    Författare :Uta Bindreiter; Juridiska institutionen; []
    Nyckelord :SAMHÄLLSVETENSKAP; SOCIAL SCIENCES; recognition; Pure Theory; presupposition; precedence; norm hierarchy; norm conflict; membership; legal ‘ought’ ; Grundnorm; direct applicability; Basic norm; bindingness; validity.; Philosophy of law; theory of law; Rättsfilosofi; rättsteori;

    Sammanfattning : The treatise is concerned with the source-—the “Grund”--of the bindingness of law. I contend, first, that the “presupposition” of the basic norm, on a certain reading of Kelsen’s doctrine, can be understood as constituting a normative source of positive law, and, secondly, that this reading of Kelsen admits of addressing the issue of the (formal) legitimacy of supra-national and “directly applicable” rules and other norms. Sammanfattning : The present thesis is an exploration of normalization processes and the problem of appropriation in labor conflict. More specifically, it analyses the way contemporary labor conflicts in nursing relate to, and thereby help to illuminate, changes in modes of gender normalization under neoliberalism, and how nurse labor conflict thereby sheds light on wider patterns of labor strife. 4. 4. Bioprospecting and deep-sea genetic resources in a fragmenting international law

    Författare :Niels Krabbe; Göteborgs universitet; []
    Nyckelord :SAMHÄLLSVETENSKAP; SOCIAL SCIENCES; public international law; law of the sea; international environmental law; WTO law; bioprospecting; biotechnology; genetic resources; deep-sea; biological diversity; areas beyond national jurisdiction; fragmentation; treaty interpretation; norm conflict; regimes; commons; conflict clauses;

    Sammanfattning : This thesis investigates if public international law manages to function as a coherent system in the case of deep-sea bioprospecting, where rules in three regimes provide seemingly inconsistent obligations for states. Based on an investigation of the development of bioprospecting and patenting of deep-sea genetic resources, the study explores how rules in the United Nations Convention on the Law of the Sea (UNCLOS), the Convention on Biological Diversity (CBD) and the World Trade Organization Agreement on Trade-Related Aspects of Intellectual Property Rights (WTO TRIPS) apply to such activities. Sammanfattning : How do international norms travel, via statebuilding efforts, into post-conflict settings, and how do international and national actors interact in this process? The empirical focus is the spreading and rooting of the norm of women’s political rights in Cambodia and Timor-Leste, two countries in which international actors have played a significant role in statebuilding efforts.
