    Sammanfattning : In the wake of a steady flow of child migrants attempting to cross borders and states’ efforts to restrict immigration, various public controversies have arisen about the rights of asylum-seeking children. The ‘moral gap’ between the outcome of democratically enacted laws and the aim of controlling immigration, on the one hand, and public calls to protect the universal rights of asylum seeking children, on the other, have created a political challenge for Western democracies.     Sammanfattning : Increased flexibility has been one of the most consistently pursued goals of civil procedure reforms in Sweden during recent decades, resulting in a near doubling of the number of rules intended to confer discretion upon the courts. Meanwhile, the Court of Justice of the EU (CJEU) has in its case law increasingly ventured into core areas of procedural law, suggesting inter alia that the legislative choice to confer discretion on the courts affects the effective enforcement of EU law.     Sammanfattning : This thesis is written within the field of architecture and urban planning. Based upon a critical examination of the Critical Planning Theory, communicative rationality and the concept of consensus, a model of communicative planning as management of conflicts is adopted as a theoretical framework together with the concepts of transparency and knowledge as qualitative aspects of an urban renewal planning process within a deliberative democratic society.
