    Sammanfattning : This study examines the degree to which the application of Article 101(1) Treaty of the Functioning of the European Union (TFEU) to patent technology transfer licensing agreements considers and promotes innovation. The study presents a new view on the patent-antitrust intersection, by exploring the competition law assessment of licensing agreements in light of the economic concept of innovation, licensing efficiency and transactional hazards. The studies described and examined the three most used shear theories in the world – the fixed angle truss model (45°TM), the variable angle truss model (VAT), and modified compression field theory (MCFT).     Sammanfattning : This thesis examines the current design of the system of case resolution mechanisms used by the European Commission (the Commission) where an infringement of Articles 101 and 102 TFEU is suspected and advances some proposals regarding this design.
