Bekvämlighetsflagg och arbetsförhållanden : En studie av rättsbildningen på sjöarbetsmarknaden

Sammanfattning: When the Swedish shipowners during the shipping crisis in the middle of the 1970:sstarted to flag out their vessels to the flag of convenience-countries (FOC) this causedan acrimonious conflict between the parties on the Swedish labour market forseafarers. To be able to compete on the international freight market the shipownersfelt it necessary to flag out their vessels while the Seafarers' Union tried to preventthis development in order to protect their members'jobs. Also the Government felt itsinterests pertaining to defence and trade threatened.The purpose of the dissertation is to analyze how this conflict has influenced the legaldevelopment on the labour market for seafarers. Due to the fact that the problem offlagging out is not a national one but an international one also the internationaldevelopment in this field is analyzed.The study is divided into three main parts. In the first part the interests of the differentparties on the national and international labour market for seafarers are described andanalyzed. In the second part of the study the legal conditions for FOC registration and the legal measures that have been taken by the Government and various national andinternational organisations in order to gain control over the situation are discussed.The latter consist in consist to prevent the registering of vessels in FOC registers,measures to regulate the labour standards on board merchant vessels regardless of theflag and finally measures to get the shipowners to re-flag their vessels in the nationalregister. In the last part of the study some concluding remarks are presented.
